no i understand what he is saying.

he says "if she wasn't raped" (had consensual sex) then she should have thought about xyz

but the point is 13 year olds cannot consent- the law states that minors are unable to consent. they are unable to make a decision to engage in sexual activities; they are not of "reasonable mind" or whatever the thing is in america. and by extension they are unable to comprehend the consequences of sexual activity.

it's a legal argument about a court's decision in florida, not a philosophical debate about what age people can decide to have sex/realise what is involved in bringing up a child. and if you want to talk about that then don't use legal words like "consent"

I stand with the government on this one. Firstly, every action has a reaction or a consequence, common knowledge. If she chose to have sex, knowing the possibility of her getting pregnant, and she was stupid enough to do it anyway, then she should have to take responsibility for that. It is unfair to take out her consequence on another human life. Everybody has the right of free agency, but when they impose their consequences on other people, then that's where it gets screwed up.
See, that's the thing these days, consequences of actions is something that is slowly disintergrating, along with society's morals and values.

no a child is still a child... if a 6 year old said she was going to have sex... she would not think of the consequences... who's to say this girl even knew there was a possiblity of getting pregnant... plus to make her have the baby after she said she doesnt want it can have catastrophic influences on how she will treat the baby in the future... she doesn't want it... girls in australia can have abortions at any age with parental sonsent (under 16's) ... has anyone asked where her parents stand on this issue...

You stand with the government on which part? The bit where they say that at 13 she's not old enough to consent, no matter what, or the part where the initially say no go @ abortion then change their decision after a psych evaluation? :) Either way your standing with the government doesn't seem to match what you've said.

Given that she's a ward of the state, I'd say what they think of it is fairly irrelevant (Her parents that is).

Also important to note that there they don't require parental permission, at least not at her age.

Well, if she doesn't want the baby, then there are other ways to deal with the issue rather than just automatically consort to abortion. She could give it up for adoption to a family who could want a child, or get a family member to take care of it :)

Her body might not be developed enough to survive childbirth. In any case, the baby would be premature, perhaps too premature to survive.
