OMG I LOVE MOCK TRIAL . . . miss it soo much *sob*

i was always a witness, and I absolutely loved messing with the barrister's heads

it was pretty shattering when we lost, after 6 consecutive wins. . .

have fun 09ers, its perhaps one of the best experiences of high school (imo, if your team is awsum personality wise)

we have a mock trial coming up but its only an in class one. so half the class is defence, the other half are prosecution, and anyone who missed out on a role got jury duty.lol.
Im the second barrister for defence, and im pretty sure we're already screwed coz (we're doing Jack and the Beanstalk mock trial) and one of our defence witnesses already claimed jack said he intended to kill the giant. oh well
Any hints on how we may be able to put a relatively strong case together would be appreciated.thanks

If it was heresay, then you hope that the prosecution objects and you can quietly remove that piece of evidence.

its hearsay evidence - just because jack said that, doesn't mean its true, or that he intended it. Play it down as a passing comment, not an intention, and stress the fact that it is hearsay.

HOWEVER, if you're taking the line of self defence, then the intention to kill isn't a problem, (intent is required for self defence anyway), rather you have to show that the threat to Jack's life was real, as he perceived it, and that his action to kill was reasonable.

A great way to put forward a strong case would be to consider the hypotheticals - what if jack didn't kill the giant? would he be alive + well? what if jack just injured the giant? would he have been able to escape safely? show that the only reasonable action to prevent Jack from harm would have been to kill the giant.

New case about Police vs Gray. A case about assault, who here is defence and prosecution. We are prosecution and are having major problems. Our barrister one is sick and he can't do it this round. Ah!! I don't want to lose!
