hi....was just wondering about ppl's answers and what you wrote about...so here are mine...

Human rights:

a) domestic HR = freedom of religion
protected = under section 116 australian constitution, which is only changed through referendum, making the right strong and difficult to abolish

b) international HR = right to asylum
protection = by international bill of rights, under the ICCPR 1966...first generation right...but, not always enforced domestically eg Tampa boat people

c) Effectiveness of the law in protecting HR:
-depends on country you live in
-eg's = tampa boat ppl and sept 11+war on terrorism

-Tampa boat ppl: didnt get right to asylum and to effective judicial remedy...were arbitarily put in detention....right to seek asylum n not be punished under ICCPR 1966.....and australia has signed treaty....but still up to aus to enforce...aus has gone against, showing weakness of IL...treaties rely on state enforcement

Aus govt has power of defence (s51const), and sending more troops to protect aus further breaches HR of iraqis...
Aus govt passed legis...BSLA bill 2002 etc but does not protect all countries..
thus can see the limited effectiveness...

Crime:

a) types of crime:
1. drug offences (eg toney's possesion, sam's illegal use, toney's possible trafficking=indictable)
2.Crimes against the person (eg toney abuses sam)
3. White collar crime = crimes against property committed by ppl re: personal economic gain...(eg toney copying tapes and breaching IPR)

b) legal measures Aus could deal with international crimes:
1. extradition(definition and role)..eg toney tried in country wanted in for drug charges
2. under UNCROC 1990 child abuse, especially sexual exploitation i s illegal...this is ratified into aus dom. law through crimes act 1900 nsw and c+yp (c+p) act 1998...thus can be enforced domestically....

c) effectiveness of legal sys. in dealing with int. crime..:
1. extradition but only effective if extradition treaty exists
2. renedition = informal concept of extradition but only consensual
3. treaties = only binding if enacted into domestic law...eg uncroc
4. police disretion means limited investigation thus many crimes unnoticed eg sams abuse and copying tapes
5. lack of police power and corruption also increases ineffective..
6. fear of reporting...such as sam reporting sex exploit and abuse (against uncroc) means crimes not reported...ineffective

d) criminal penalties generally do reflect community standards and expextations: (really struggled.....no good points)

1. abolition of capital p'ment
2. standard of proof beyond reasonable doubt (pment given only if sure person is guilty...shows values of accused rights)
3. but...Bilal gang rapists 55 years, Pauline Hanson's 3/4 years...Pauline's sentence criticised as being too high in cimparison with only 55 years for planned gang rape..not a reflection....crap crap crap....
4. sentencing act 1989 ensures 3/4 of sentence carried out in detention before parole allowed...=incapacitation, rehab...
5.Youth Justice Conferencing.....reflects expextation children protected and rehab...
6. jury (judge by peers) decide guilt or inno..reflects society's views of whether person is guilty/should be punished???bull...lol
7. judge considers aggravating and mitigating factors when deciding penalty
8. community service and good behaviour bonds reflect expectation that everyone should contribute to society..
9. drug court nsw = rehab non violent drug offenders

looks about right.

it kills me how people think Pauline Hanson recieved such a severe sentence, she's a fraud and a racist she should've got life in prison.

white collar crime is in the business world, yes. but tony may have ben in business selling child pornography and videos...otherwise, why would he be mass producing/copying videos?

hence, toney is breaching intellectual property rights (a business related concept) in order to gain personal economic benefits.

i wish i talked about Pauline Hanson in the question, i could've said something like: many have argued that Mrs. Hanson's punishment was arbitrary and as part of a witch hunt in both the Queenslad and Commonwealth level (although i t would eat me alive). The unfairness is so alarming that I AM SURE THAT MRS. HANSON WOULD BE RELEASED ON APPEAL, BECAUSE THE JUDICIAL SYSTEM DOES WORK IN AUSTRALIA!!!

Probably would've got full marks just for that :p

For HR i wrote eduation domestically and rights for children for development, life, survival and development (CROC)

She is not a fraud, remember she was acquitted so be careful what you say, she can sue you for defamation. Your hatred of conservatives shows your lack of legal application to this situation. Remember also there is a difference between criticism and racism, I am of migrant decent, and I do not find Pauline Hanson's policies the slightest racist, in fact she is stopping favouring in our community, reaching true equality.

yes, no racism here mate...i'm not Asian but I can see that what she's saying can be easily applied to all other minority groups in Australia. Read your history books my friend. Your ignorance, rather than mine, is what is clearly evident!

P.S. all Australians are originally of migrant descent. Being an immigrant (which I am as well) doesn't make you any less of a blind fool.

You know Golani, I despise people like you, who take it for granted that you will be able to live in such a beautiful country and be able to nit-pick every conservative or right wing politician, because YOU view them racist. Have you heard a recent policy interview with Pauline Hanson, whilst she was in One Nation? I am not a One Nation supporter, but to attack Hanson on freedom of speech, something you are using to criticise her, is childish, you have not presented even one strong argument apart from an adaptation of her speech whilst there was no One Nation, even then that speech says people will call her racist, and she was right you did - but she never said she was, she just knew that some clowns out there who encourage "ghettoes", who encourage a resistance to the host culture and who believe that ALL are migrants of this nation, would say that.

It's such a topical issue!

I'm asian and I it's clear to me what Hanson and ppl like her are saying. I think everyones entitled to their own opinion.

Look around and see how much crime today is committed by ethnic 'minorities'. A crap load.

On the other hand, there are goodies out there, like myself :) who appreciate peace and liberty (I'm not tryin to sound like George Bush :)) and appreciate different cultures and...foods they bring! ie. I love a good curry! hehe

So you gotta understand, there are 2 sides to every story. Not everything you hear on the news, etc is true! I mean look at your friends and you never think about what colour or ethnicity they are! We're all the same!

WOW. How wrong are you! Because I don't take my freedom and quality of life for granted do i have to stand up for my freedom and others' from people like Pauline Hanson who seek to drive me out.

I attack her based on the things she says and based on her history because they are, naturally, an excellent indication of her true personality and her views.

I have listened to interviews, statements, press releases, read missiion statements, policy pamphlets and more, upon all of which i based my opinion, not on the color of her skin, or her accent, or her nationality and so forth because i'm being fair....you aren't....

I absolutely agree Suga. But remarkably enough those minorities whom you talk about (or so i assume) aren't the main focus of Pauline Hanson's policies and remarks. Asians are, which are in fact hard working, and have been proved to contribute to the Australian economy and society.

and Shaza: kakdilla, zeibic, idisuda, spaciva. That's pretty much all i know in Russian :p

I think Pauline's political views and policies are irrelevant in the debate about whether she is innocent or not. No-one ever got jailed for being a goose...
