If someone were to open up a P2P file sharing program now, they would be instantly tracked by their ISP and also instantly banned from the internet and anything to do with a phone line?

It's a remote possibility that can arise if the file that's being shared contain nasties. You will not get instantly banned but you can get a written warning through your ISP. (This has never happened to me btw.)
