Seriously, what is the deal with this essay?

How is contract law applied differently to employment contracts.

Someone help, please! Ill make it worth your while.

did u (or anyone) go to the essay consultation hour that was held.. i couldnt go had to study for accounting.. wat a waste.. yeh if anyone can post some helpful hints would be great :)

hmm,we didn't have to do this essay. do you guys still have to do a court report?

I'm the student rep and I can't tell you why the assignment was set. Probably because it's the easiest way to distinguish the candidature. Giuseppe's a genuinely nice guy, he just has to do these things.

All I can suggest to you is to check out the public library for books on employment law (as Fisher, with it's book:student ratio of 1:20 has dried up) or go back to Legal Studies for help on employment law - it covered a bit on contracts.

right so from what ive done so far, im talking about the precedence of regulation such as federal/state/award/agreement over contracts, implied and express terms under statutes and requirements concerning specific detail of terms (which need not be exhaustive due to the provisions under awards and agreements) and adjustments to terms during employment.

am i on the right track? i really have no idea. i havnt been to a lecture yet.

It wouldn't matter. Whatever tack you chose is bound to work as Law is such a diverse field.

I went to the UNSW law library yesterday and it puts Sydney to shame. Even though it's Sydney's 2nd dirtiest air-conditioning spire, it has some good books.

Back on topic:

Do you guys think that Carr v. McDonald's is an employment contract or not?

Given that Carr is trying to be a franchisee of McDonald's does that make him an employee of McDonald's?? I'm not 100% sure. Please Clarify. Thanks in Advance.

hehe i dont really know that case so ''i dont know" but in regards to the 1st assignment u can pick it up from the eco and business faculty building at the front.. (if u havent already just have ur SID with u)..

If all the employment books are still out at Fisher, u can get them from the state library.

yeah, i'm using foreign cases as well e.g. Carlill v Carbolic Smoke Ball is an English case and it plays a pretty important role in formation.

Yeah i'm doing an all-nighter as well - first time. Went to the state library today - a lot of CLAW1001 students.

Carlill v. Carbolic doesn't look like an employment issue contract law case??

I'm not saying it is. I'm saying that just because cases are foreign doesn't mean that they're irrelevant.
