That would only apply if one party was deliberately taking advantage of the other party. In the event when neither party is trying to take advantage of the other, the fact that they are intoxicated becomes irrelevant, assuming that they are both unable to make a decision free from impairment.

To get into ADFA, redoing the HSC or doing the TPC at TAFE; or going back to school to repeat year 11 and 12 seemed to be my only options, and I figured that if I chose the HSC, I would be able to do subjects that I already had experience in. My ATAR from 2010 was only 56.30.

Well that's part of it, but also because I want to get into ADFA or a high ATAR cut-off degree at somewhere like UNSW. I figured that redoing the HSC would be the best way to go because it keeps options open, as opposed to some of the foundation courses that universities offer.
